Thousands of people in the US are vaccinated against numerous illnesses and diseases on a daily basis. Vaccination has become a common health practice with few negative outcomes. Still, in rare cases, people and children can suffer severe and unpredictable reactions to vaccination. These reactions can sometimes include some light side effects such as arm and shoulder pain, but in some cases also some severe neurological conditions, seizures, and sometimes even death.

There is absolutely no way to predict the reactions of individuals after vaccination, but there are ways to protect yourself and your family members against unforeseen events in these cases. Even though you won’t be able to prevent these events from happening, you can inform yourself about the possible steps you can take if you or your family members react unpredictably to a vaccination shot.

As a result of many negative reactions to vaccinations, Congress decided to create the National Vaccine Injury Compensation Program (NVICP) to provide additional help to all the victims of unfortunate vaccine reactions, administered both in the private and public health sectors. To be able to qualify for the NVICP program, you or someone from your household must be experiencing an illness or injury due to a vaccine shot.

In order to be eligible for compensation under the program, your claim must be brought before the United States Court of Federal Claims. Every vaccine-related claim is heard by the Office of Special Masters. Since the vaccine program is the responsibility of the United States Department of Health and Human Services, the Department of Justice is tasked with representing the HHS against all claims brought against the agency.

When your claim is heard, the Office of Special Masters employs eight such masters who are experts in vaccine injury claims. One of these eight will be assigned to your case and preside over the claim if a hearing is required in determining a final ruling.

Vaccine-related Injuries and Reactions

There are a variety of injuries that could be sustained from a vaccination. If you suspect that you have sustained one or more of the following injuries or reactions, you may be able to file a claim to receive compensation for your lost income, medical costs, and pain and suffering.

SIRVA

An acronym for Shoulder Injury Related To Vaccine Administration and one of the most common reactions associated with the administration of vaccines. This is because many vaccines are injected into the shoulder, among them influenza and tetanus shots. While such an injection is bound to come with a little soreness and discomfort at the injection point, that pain typically goes away after a day or two.

However, SIRVA is a condition that can bring intense agony and restrict the range of motion of the upper arm and shoulder. There are other conditions that can come from a vaccine injected into these areas of the body, such as brachial neuritis or plexus, adhesive capsulitis, torn rotator cuff, bursitis or tendinitis of the shoulder, and other forms of chronic pain and discomfort.

GBS

Short for Guillain-Barre Syndrome, GBS is typically associated with the flu vaccine. Anyone with GBS can suffer the effects in various stages, starting with weakness or tingling in the legs and more advanced versions come with paralysis of muscles near the injection site and other areas. The most extreme cases can lead to complete paralysis which could be deadly.

Other Vaccine-related Injuries and Conditions

While SIRVA and GBS are the most common injuries that can be experienced after a vaccine is administered, there are others you could experience and would allow you to file a claim. Such diagnoses include but are not limited to: Acute Disseminated Encephalomyelitis (ADEM), Bell’s Palsy, cerebellar ataxia or ataxia, Chronic Inflammatory Demyelinating Polyneuropathy (CIDP), Immune thrombocytopenia (ITP), Lupus, Myositis, and Vasculitis.
